One District Constable’s Assault Conviction Overturned; Other Upheld
District Constable Neville Wallace had his assault conviction and sentence overturned yesterday in the Court of Appeal, but his colleague, Roy ‘Ray’ Higgins, wasn’t as lucky, as his conviction was upheld.
Both district constables were convicted in 2008 on charges of severely beating and pepper-spraying an inmate who relocated himself to another cell due to a roach infestation at the Gun Court Remand Centre in Kingston. So severely was he beaten that he was taken in an unconscious to the Kingston Public Hospital where he stayed for three days. On their conviction last year in the Corporate Area Resident Magistrate’s Court, both district constables were ordered to each pay $10,000 or serve six months in prison. They both appealed the conviction.
Yesterday however, the Court of Appeal determined that it was Higgins who actually assaulted the inmate on the day in question, and as such, Wallace’s conviction was overturned.

i think that those two district constabulary should be penalized and face the consiquenciesthank you.
