Janice Allen Case – No Retrial For Acquitted Policeman

Constable Rohan Allen, the policeman who was acquitted in the highly publicized Janice Allen case, will not face another trial. Director of Public Prosecutions (DPP) Paula Llewellyn ruled yesterday the Crown would not be in a position to establish a case against him.

The DPP gave very detailed reasons and recommendations, saying that the Crown would not be able to establish a nexus or link between Constable Allen and the M-16 firearm from which the fragments of bullets were found in the girl’s body. She said she found no evidence of fraud in the case, thus putting to rest the contention in the case that the verdict of acquittal was obtained by fraud.

She recommended that the commissioner of police order a departmental inquiry in respect of the entire circumstances that led to the unfortunate and tragic shooting of the girl. She also called for departmental inquiry touching and concerning the unavailability of the relevant records pertaining to the case. Additionally, she called for investigators of police shootings to ensure that certified copies of the relevant entry are made in the Firearms Register at the police station.

An appeal regarding the acquittal of Constable Allen was turned down in March of this year by the UK Privy Council.
